Cosmetic Procedure Aboard has gone wrong!

Irish people travelling abroad to avail of cheaper costs of surgical cosmetic procedures has been the subject matter of much press coverage in recent years, with the press particularly taken by the savings which can be achieved versus the costs of privately funding such procedures in this jurisdiction.

The website whatclinic.com noted that traffic through the website had recorded that the Czech Republic, Poland, Belgium and Britain are the medical tourism hotspots for Irish medical tourists – “the number of Irish enquiries to foreign clinics through Whatclinic.com for cosmetic surgery has increased by 54% over the past year from 1,450 queries in 2013 compared to 942 queries in 2012.

It is probable that the findings of the individual website are reflective of a growing trend whereby increasing numbers of Irish patients are travelling to seek cheaper elective, primarily cosmetic, medical and dental surgeries abroad.
This has given rise regrettably to an increase in the number of people who are unhappy with the outcome and nature of the surgeries performed and wishing to bring actions to recover damages.

The Injuries Board under assessed my case by €311,736.26

Gary Matthews has issued a call for a “realistic review of the 2004 Book of Quantum” following a successful case before The High Court.

The man was awarded €38,263.73 by the Injuries Board to compensate him for general damages, pain and suffering and future pain and suffering. After rejecting the Injuries Board Assessment and contacting the firm of Gary Matthews Solicitors, his case was ultimately settled for €350,000.00, a difference of €311,736.27 from the Injuries Board Assessment and an increase of 914% from the Assessment figure!

Case Study: Girl (5) awarded €55k after she fell and struck her head against wall in creche

A five-year-old girl, who will be scarred for life after she struck her head against a wall in a creche, was today awarded €55,000 damages in the Circuit Civil Court.

Barrister Robert Crowley told the court that Ruth Reilly had been left unattended at Giraffe Childcare Creche, Athlumney Wood, Johnstown, Navan, Co Meath, in October 2013 when she fell and struck her head.
Circuit Court President Mr. Justice Raymond Groarke heard that Ruth, who was two-years-old at the time, suffered a deep laceration and had been bleeding heavily.
The court was told an ambulance was called and after her wound was dressed on site, Ruth was taken to Our Lady of Lourdes Hospital, Drogheda, Co Louth, where it was stitched.

Judge Groarke, awarding Ruth €55,000 damages, said her scar was nasty and noticeable at a conversational distance.

He said that although he was not criticising the way the defendant had handled the case, in his view the €40,000 settlement offer did not meet the full value of the case.
