The High Court has awarded €87,000 to a woman for injuries she suffered when she was knocked off her bicycle by a van.

Giving his ruling on Thursday, Mr Justice Michael Hanna said this was the first case that he was required to assess under the personal injuries guidelines introduced last year with the aim of bringing more consistency to damages awarded.

PIAB to have role in Garda compensation claims (via Irish Legal News)

The Personal Injuries Assessment Board (PIAB) will assess claims from gardaí injured as a result of malicious incidents under legislation approved by the Oireachtas.

The Garda Síochána (Compensation) Bill 2021 provides for a complete overhaul of the current Garda compensation scheme which has been in operation since the 1940s.

The compensation scheme is for members of An Garda Síochána who sustain personal injuries in the performance of their duties, to help affected members get support necessary for their recovery and compensate them for their injuries.

The scheme is also open to dependants of deceased members of An Garda Síochána who were fatally injured while on duty, or while acting in their general capacity as a member, or merely because of their being a member of An Garda Síochána.

Friends’ personal injury claims dismissed over misleading evidence (via Independent.ie)

Two friends who brought personal injury claims after a lorry “grazed” a car while they were parked in the hard shoulder of the M7 have had their claims dismissed for giving misleading evidence and failing to disclose details of previous accidents.

Christian Carluccio and Leonid Iliev sued Dungarvan Transport Ltd and driver Gruselionis Valdas following an incident on November 15, 2018.

The pair claimed they had pulled in to check if there was a puncture when they were struck by a lorry, which resulted in them suffering neck, back and knee injuries.

While the defendants admitted liability, they disputed the level of impact and the veracity of the claims.

The lorry involved had cameras installed on the front, rear and sides, and CCTV of the incident was shown in court, with Mr David Roberts BL pointing out how the car the plaintiffs were in “didn’t even move”.
